  3. By installing and using GammaCAD PRO you are agreeing to be bound 
  4. by the terms of this Agreement. If you do not agree to the terms 
  5. of this Agreement, promptly delete GammaCAD PRO from your computer.

  7. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. 
  8. GAMMA SOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, 
  9. INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, 
  10. FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT 
  11. SHALL GAMMA SOFTWARE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES 
  12. WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS 
  13. PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER 
  14. PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE 
  15. SOFTWARE, EVEN IF GAMMA SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF 
  16. SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR 
  17. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE 
  18. ABOVE LIMITATION MAY NOT APPLY TO YOU.

  24. GammaCAD PRO is NOT a public domain program.  It is copyrighted by
  25. Gamma Software.  This software and accompanying documentation are
  26. protected by United States copyright law and also by international
  27. treaty provisions.

  29. Gamma Software grants you a limited license to use this software
  30. for evaluation purposes for a period not to exceed 40 uses or 60 days,
  31. whichever occurs first.  If you continue using this software after this
  32. evaluation period, you MUST make a registration payment to Gamma
  33. Software.

  35. You may not use, copy, rent, lease, sell, modify, decompile,
  36. disassemble, otherwise reverse engineer, or transfer the licensed
  37. program except as provided in this agreement.  Any such unauthorized
  38. use shall result in immediate and automatic termination of this license.
  39. All rights not expressly granted here are reserved to Gamma Software.

  42. LIMITED DISTRIBUTION LICENSE

  44. All shareware vendors may distribute GammaCAD PRO, completely unaltered,
  45. without further permission; for other cases or to distribute in modified
  46. form, you must consult the attached data record, which is hereby
  47. incorporated by reference.  Any distribution satisfying all the
  48. distribution requirements expressed in that data record is hereby
  49. authorized.

  51. Permission to distribute the GammaCAD PRO package is not transferable,
  52. assignable, saleable, or franchisable.  Each vendor wishing to
  53. distribute the package must independently satisfy the terms of this
  54. limited distribution license.

  56. U.S. Government Information:  Use, duplication, or disclosure by the
  57. U.S. Government of the computer software and documentation in this
  58. package shall be subject to the restricted rights applicable to
  59. commercial computer software as set forth in subdivision (b)(3)(ii) of
  60. the Rights in Technical Data and Computer Software clause at
  61. 252.227-7013 (DFARS 52.227-7013).  The Contractor/manufacturer is Gamma
  62. Software, PO Box 7192, Louisville, KY 40257, U.S.A.

  64. Gamma Software may revoke any permissions granted here, by notifying you
  65. in writing.  All rights not expressly granted here are reserved to Gamma
  66. Software.

  68. No fee can be charged for the software itself.  A reasonable fee may be
  69. charged for distribution.  It must be made clear to the buyer that any
  70. fee they are paying is not for the software. The fee is only for the
  71. distribution of the software.  An additional payment to Gamma Software
  72. (author) is required for the buyer to continue using the program beyond
  73. the evaluation period.  A statement which accurately describes this must
  74. be available to the buyer before the purchase.  The following statement
  75. is recommended.

  77. Shareware is an exciting marketing method that allows you to try top
  78. quality software before you pay the author.  With Shareware, you cannot
  79. be disappointed spending money on a program that's not right for you.
  80. The small fee you pay to us covers only the duplication and distribution
  81. costs, and permits you to evaluate the program.

  83. If you continue to use the program, you must send the author an
  84. additional payment, which may entitle you to technical support, printed
  85. manual, bonus programs, and more.  Your payment supports the authors,
  86. enabling them to continue writing newer and better Shareware programs.

  88. Only the Shareware version may be distributed.  They can be identified
  89. by the initial dialog identifying them as an evaluation copy. The
  90. registered versions do not contain these screens.

  92. Only the latest version can be distributed.  If you let us know you are
  93. distributing this program, we will send you updates as they become
  94. available.

  96. Violation of any of the above conditions results in the immediate
  97. termination of the Distributors right to distribute the above program.

  99. Any method of distribution may be used as long as the above conditions
  100. are met.  Distribution via disk, bbs, on-line systems and CD-ROM are
  101. allowed.

  103. Gamma Software affirms that it owns all rights to the above mentioned
  104. software program.

  106. This is a non-exclusive agreement and Gamma Software reserves the right
  107. to use other agents and distribution methods as it sees fit.

  109. This Agreement is governed by the laws of the State of Kentucky.
